Introduction and Acceptance

Welcome to DiasporaHub (“we,” “our,” “us,” or the “Platform”). These Terms of Use (“Terms”) govern your access to and use of the DiasporaHub website, mobile applications, and all related services (collectively, the “Platform”).

By accessing or using DiasporaHub, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform.

DiasporaHub is a platform designed to connect Romanians living across Europe with job opportunities, housing, services, and community connections. We provide a space where employers, job seekers, service providers, and community members can interact, share information, and conduct transactions. 

2.Definitions

Throughout these Terms, the following definitions apply:

“Employer”A User who posts job listings, reviews applications, or hires through the Platform
“Service Provider”A User who offers services such as accounting, legal advice, transport, or consulting
“Marketplace Seller”A User who lists items for sale or rent, including housing, cars, electronics, or household items
“Buyer”A User who purchases or rents items from the Marketplace
“Content”Any information, text, images, listings, messages, or materials posted on the Platform
“Listing”Any job posting, service offering, or marketplace item posted by a User 

3. Eligibility and Account Registration

3.1 Age Requirement

You must be at least 18 years old to create an account or use DiasporaHub. By registering, you confirm that you meet this age requirement.

3.2 Account Creation

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information

  • Maintain and update your information as needed

  • Keep your login credentials confidential

  • Notify us immediately of any unauthorized account use

  • Take responsibility for all activities that occur under your account

3.3 Account Types

DiasporaHub offers two primary account types:

Job Seeker Account:

  • Browse and apply to jobs

  • Save jobs and searches

  • Post in community forums

  • Send and receive messages

Employer Account:

  • Post and manage job listings

  • Review and manage applications

  • Post marketplace listings

  • Create and manage company profile

Users may hold only one account and may not share accounts with others.

3.4 Account Suspension or Termination

We reserve the right to suspend or terminate any account at our sole discretion, without notice, for conduct that violates these Terms or harms the Platform, other Users, or our business interests.

4. User Conduct and Prohibited Activities

4.1 Acceptable Use

You agree to use DiasporaHub only for lawful purposes and in accordance with these Terms. You are responsible for all Content you post, including job listings, marketplace items, community posts, and messages.

4.2 Prohibited Activities

You may not use DiasporaHub to:

  • Post false, misleading, or fraudulent job listings, services, or marketplace items

  • Discriminate against any individual based on race, ethnicity, gender, age, religion, disability, or any other protected characteristic

  • Harass, threaten, or intimidate other Users

  • Post content that is defamatory, obscene, offensive, or violates any law

  • Spam other Users with unsolicited messages or advertisements

  • Impersonate any person or entity

  • Attempt to gain unauthorized access to our systems

  • Collect User data without consent

  • Post any content that infringes on intellectual property rights

  • Post jobs requiring upfront payment or that violate employment laws

  • List illegal items or services on the Marketplace

  • Engage in fraudulent or deceptive practices

4.3 Job Posting Requirements

Employers agree that all job postings will:

  • Clearly state the job title, description, location, and compensation

  • Comply with all applicable employment laws and regulations

  • Not require payment from applicants for application or training

  • Not be for positions that are illegal or violate labor standards

4.4 Marketplace Listing Requirements

Sellers agree that all marketplace listings will:

  • Accurately describe the item or service being offered

  • Include accurate pricing and location information

  • Comply with all applicable laws regarding the sale of goods

  • Not include counterfeit, stolen, or prohibited items

5. Job Listings and Applications

5.1 Job Posting by Employers

Employers may post job listings on the Platform. Each job posting must be accurate, complete, and comply with these Terms. We reserve the right to review, edit, or remove any job posting that violates our policies.

Job postings expire after 30 days unless renewed by the Employer. Employers may close a job posting at any time.

5.2 Job Applications by Job Seekers

Job Seekers may apply to job listings by submitting their profile and cover letter. By applying, you authorize us to share your application information with the Employer.

We do not guarantee that Employers will review, respond to, or consider any application. We are not responsible for hiring decisions made by Employers.

5.3 No Employment Guarantee

DiasporaHub is a platform that connects Users. We do not guarantee that Job Seekers will find employment or that Employers will find suitable candidates. We are not a party to any employment relationship between Users.


Marketplace Transactions

6.1 Listing Items

Sellers may list items for sale or rent on the Marketplace. Each listing must include accurate description, price, location, and condition. Sellers are responsible for ensuring their listings comply with all applicable laws.

6.2 Transactions

Transactions between Buyers and Sellers are conducted directly between the parties. DiasporaHub does not process payments, hold funds, or act as an escrow agent.

6.3 Disputes

Any disputes arising from Marketplace transactions must be resolved directly between the Buyer and Seller. DiasporaHub may, at our discretion, assist in dispute resolution but assumes no liability for transaction outcomes.

6.4 Prohibited Items

The following items may not be listed on the Marketplace:

  • Illegal drugs or paraphernalia

  • Weapons or firearms

  • Stolen goods

  • Counterfeit items

  • Adult content or services

  • Live animals

  • Human body parts or fluids

  • Hazardous materials

  • Real estate requiring real estate license


Community Forums and Content

7.1 User-Generated Content

Users may post content in community forums, including questions, answers, comments, and discussions. You retain ownership of your content but grant DiasporaHub a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content on the Platform.

7.2 Content Moderation

We reserve the right to review, edit, or remove any community content that violates these Terms or our Community Guidelines. We may also suspend or ban Users who repeatedly violate our policies.

7.3 No Legal Advice

Content posted in community forums is for informational purposes only and does not constitute legal, financial, or professional advice. Users should verify information independently before relying on it.


Direct Messaging

8.1 Messaging Feature

DiasporaHub provides a direct messaging feature that allows Users to communicate privately. Messages are stored on our servers and may be reviewed for compliance with these Terms.

8.2 Appropriate Use

You agree to use messaging only for legitimate purposes related to jobs, marketplace transactions, or community discussions. Harassment, spam, or inappropriate messages are strictly prohibited.

8.3 Safety Warning

We encourage Users to exercise caution when communicating with strangers. Do not share personal financial information or send money to Users you have not met in person.


Fees and Payments

9.1 Free Services

Creating an account, browsing jobs and listings, applying to jobs, and participating in community forums is free.

9.2 Paid Services

We may offer paid features, including:

  • Featured job listings

  • Featured marketplace listings

  • Premium employer accounts

  • Subscription plans

Fees for paid services will be clearly disclosed before purchase. All payments are non-refundable unless otherwise stated in our Refund Policy.

9.3 Payment Processing

Payments are processed through third-party payment processors. By purchasing paid services, you agree to the terms of our payment processors.


Intellectual Property

10.1 Our Intellectual Property

The DiasporaHub name, logo, design, and all content not posted by Users are our intellectual property and may not be used without our written permission.

10.2 User Content

You retain ownership of content you post. However, you grant us a license to use, display, and distribute your content to operate the Platform.

10.3 Copyright Infringement

If you believe content on DiasporaHub infringes your copyright, please contact us with:

  • Identification of the copyrighted work

  • Identification of the infringing content

  • Your contact information

  • A statement of good faith belief

  • Your signature

Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using DiasporaHub, you consent to our data practices as described in the Privacy Policy.


Disclaimer of Warranties

DiasporaHub is provided “as is” and “as available” without warranties of any kind, either express or implied.

We do not warrant that:

  • The Platform will be uninterrupted, secure, or error-free

  • Results obtained from the Platform will be accurate or reliable

  • Any errors will be corrected

We are not responsible for:

  • The accuracy of job listings or marketplace items

  • The conduct of any User, including Employers, Job Seekers, Buyers, or Sellers

  • Any loss or damage resulting from User interactions


Limitation of Liability

To the maximum extent permitted by law, DiasporaHub and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform.

Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim, or €100 if you have not paid us.

This limitation applies regardless of the legal theory on which the claim is based.


Indemnification

You agree to indemnify and hold harmless DiasporaHub and its owners, employees, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from:

  • Your use of the Platform

  • Your violation of these Terms

  • Your violation of any rights of another User

  • Your content or listings


Termination

15.1 Termination by You

You may delete your account at any time through your account settings. Upon deletion, your profile and content will be removed, though some information may be retained as required by law.

15.2 Termination by Us

We may suspend or terminate your account at our sole discretion, without notice, for:

  • Violation of these Terms

  • Conduct that harms the Platform or other Users

  • Fraudulent or illegal activity

  • Extended inactivity

15.3 Effect of Termination

Upon termination, your right to use the Platform ceases immediately. Sections regarding intellectual property, limitation of liability, indemnification, and dispute resolution shall survive termination.


Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of DiasporaHub after changes constitutes acceptance of the modified Terms.

We will notify Users of significant changes via email or through the Platform.


Governing Law and Dispute Resolution

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

17.2 Dispute Resolution

Any dispute arising from these Terms or your use of DiasporaHub shall be resolved through:

Informal Resolution:
Please contact us first at legal@diasporahub.com to resolve disputes informally.

Mediation:
If informal resolution fails, the parties agree to submit to mediation before pursuing legal action.

Arbitration:
Any unresolved disputes shall be resolved through binding arbitration in London, United Kingdom, in accordance with the rules of the London Court of International Arbitration.

17.3 Exceptions

Either party may seek injunctive relief in court to prevent irreparable harm.


Miscellaneous

18.1 Entire Agreement

These Terms constitute the entire agreement between you and DiasporaHub regarding your use of the Platform.

18.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force.

18.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

18.4 Assignment

You may not assign these Terms without our written consent. We may assign these Terms without restriction.

18.5 Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control.
